Terms of Use
1. Who can use Nowby
You must be at least 18 years old to use Nowby. By using it, you confirm that you are 18 or older and legally able to enter this agreement.
2. Your account
Keep your account information accurate and your login secure. You're responsible for everything that happens under your account. Tell us at hello@nowby.us if you suspect unauthorized use.
3. What Nowby is
Nowby helps people discover and coordinate spontaneous, in-person, platonic meetups with others nearby. Nowby provides the platform that makes introductions possible — it does not organize, supervise, or take part in any meetup.
4. Community rules
When you use Nowby, you agree not to:
- Harass, threaten, abuse, or harm anyone;
- Use Nowby for dating, romantic, or sexual solicitation, or for any commercial solicitation;
- Impersonate anyone or misrepresent who you are;
- Post anything illegal, hateful, sexually explicit, or that violates someone's rights;
- Collect or misuse other users' information;
- Interfere with, disrupt, or attempt to break the security of the service.
We may remove content and suspend or terminate accounts that break these rules.
5. Your content
You keep ownership of the content you create on Nowby. You grant us a limited, non-exclusive license to host, store, and display that content as needed to operate the service. You're responsible for what you post and confirm you have the right to post it.
6. Subscriptions, billing & renewals
Some Nowby features require a paid subscription. The following applies to all subscriptions:
- Where you pay. Subscriptions are sold and billed through the app store you downloaded Nowby from (the Apple App Store or Google Play). Payment is charged to your store account at confirmation of purchase.
- Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing & canceling. You manage or cancel your subscription in your Apple App Store or Google Play account settings — not inside Nowby. Canceling stops future renewals; it doesn't refund the current period.
- Pricing. Current prices and what each plan includes are shown at the point of purchase. We may change prices going forward; changes won't affect a period you've already paid for.
- Refunds. Refunds are handled by the app store under its policies, not by Nowby directly.
7. Safety & meeting in person
Use common sense: meet in public places, tell someone where you're going, trust your instincts, and leave if you feel unsafe. Nowby is not responsible for the conduct of any user — online or in person — and you release us from claims arising out of your interactions or meetups with other users. Always block and report anyone who makes you uncomfortable.
8. Termination
You can delete your account at any time in the app. We may suspend or end your access if you break these Terms or to protect Nowby and its users. Sections that by their nature should survive termination (such as content licenses, disclaimers, and limitations of liability) will continue to apply.
9. Disclaimers
Nowby is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't guarantee that Nowby will be uninterrupted, error-free, or that it will meet your expectations.
10. Limitation of liability
To the fullest extent permitted by law, Nowby and Nexitel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service, including any interaction or meetup with another user. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $100.
11. Indemnification
You agree to indemnify and hold Nowby and Nexitel harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms.
12. App Store terms
If you downloaded Nowby from the Apple App Store, you also acknowledge:
- These Terms are between you and Nowby only, not Apple. Nowby, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product-liability, legal/regulatory, or intellectual-property claims).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You confirm you are not located in a country subject to a U.S. embargo or designated as "terrorist-supporting," and are not on any U.S. prohibited-parties list.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law rules, and this applies to all users regardless of where they are located. Disputes will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll update the date above and, where appropriate, notify you in the app. Continuing to use Nowby after changes means you accept the updated Terms.
